ARC Medical (“ARC Medical,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, and share information when you visit our website at www.arcmedicalcenter.com, contact us, or participate in our text messaging program.

ARC Medical is an accident recovery clinic providing medical evaluation, imaging, pain management, therapy, and related services to patients recovering from injury. We operate clinic locations in Utah and Idaho.

Our text messaging program operates under the program name ARC Medical Patient Messaging.

2. Scope of This Policy

This Privacy Policy applies to information we collect through our website, our online and telephone contact channels, and our text messaging program.

Protected health information created or received in the course of treatment is governed separately by our Notice of Privacy Practices under the Health Insurance Portability and Accountability Act (HIPAA), which is provided to you at intake and is available on request. Where the Notice of Privacy Practices and this Privacy Policy address the same information, the Notice of Privacy Practices controls.

3. Information We Collect

Information you give us

  • Contact and identifying information — your name, mailing address, email address, and telephone number.
  • Information you submit through our forms — including appointment requests, referral information, and any message or description of your situation that you choose to send us.
  • Mobile number and text messaging records — your mobile telephone number, your consent to receive text messages, the date and method of that consent, and any later opt-out request. We refer to this collectively as SMS opt-in data.

Information we collect automatically

  • Website usage information — your IP address, browser type and version, device type, operating system, referring page, the pages you view on our site, and the dates and times of your visits.
  • Cookies and similar technologies — small data files placed on your device that allow the site to function, remember your preferences, and help us understand how the site is used. Most browsers allow you to refuse or delete cookies through their settings; some parts of the site may not function properly if you do.

Call tracking

We use a third-party call tracking service that operates on our behalf. This service may display a different telephone number to different visitors so that we can understand which parts of our website and advertising lead people to contact us. When you call a number displayed on our website, this service may collect your telephone number, the date, time, and duration of the call, and the page or source that referred you. Calls to our offices may also be monitored or recorded for quality, training, and documentation purposes. This service is contractually restricted to using this information only to provide services to us.

4. How We Use Information

We use the information described above to:

  • Schedule, confirm, reschedule, and remind you about appointments;
  • Coordinate your care, including follow-up after visits, imaging and referral status, and communication with the providers involved in your treatment;
  • Respond to your questions, requests, and messages;
  • Send you our text messages if you have opted in, as described in Section 6;
  • Ask for your feedback or a review of your experience with us;
  • Handle billing, records requests, and administrative matters relating to your care;
  • Operate, maintain, secure, and improve our website;
  • Comply with our legal, regulatory, and professional obligations.

5. Sharing of Information

We treat your information as confidential. The circumstances in which we disclose it are limited and described below.

We do not sell, rent, or trade your personal information. We do not disclose your information to third parties for their own advertising or marketing purposes.

We may disclose information in the following categories of circumstances:

  • Service providers acting on our behalf. We use vendors to operate our website, host our systems, manage scheduling and communications, deliver text messages, and provide the call tracking described in Section 3. These vendors receive only the information they need to perform their function for us, and they are contractually prohibited from using it for any other purpose, including their own marketing.
  • Legal and regulatory requirements. We may disclose information where required by law, regulation, subpoena, court order, or other valid legal process, or where necessary to protect the rights, safety, or property of our patients, our staff, or the public.
  • Business transfers. If ARC Medical is involved in a merger, acquisition, or transfer of assets, information may be transferred as part of that transaction, subject to the protections of this policy.
  • With your authorization. Any other disclosure — including to an attorney, insurer, employer, or family member — is made only with your signed authorization, or where a valid legal process requires it. We do not provide your information to any third party in exchange for payment, referral fees, or marketing consideration.

No mobile information, including SMS Opt-in data will be shared with third parties/affiliates for their direct marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

6. Text Messaging (SMS) Program

How you opt in

We send text messages only to individuals who have given us their express consent to receive them — for example, by providing a mobile number and agreeing to receive text messages on one of our forms, or by requesting text communication from our staff. Consent to receive text messages is not a condition of receiving treatment from us or of purchasing any good or service.

What we send

Messages sent under ARC Medical Patient Messaging fall into these categories:

  • Appointment confirmations, reminders, and scheduling or rescheduling notices;
  • Care coordination and clinical follow-up, such as referral and imaging status, therapy follow-up, and responses to questions you send us;
  • Account and administrative notifications, such as records requests and billing notices;
  • Occasional requests for your feedback or a review of your experience with our clinic.

We do not send you advertisements on behalf of any other company, and we do not provide your mobile number or SMS opt-in data to any third party for their marketing purposes.

Message frequency and cost

  • Message frequency varies per user.
  • Message and data rates may apply.
  • Text HELP for help. Text STOP to unsubscribe.
  • Carriers are not liable for delayed or undelivered messages.

How to opt out

You may stop receiving text messages at any time by replying STOPENDCANCELUNSUBSCRIBE, or QUIT to any message we send. You will receive one final message confirming that you have been unsubscribed, after which we will send no further texts unless you opt in again. You may also opt out by calling us at (801) 697-6006 or emailing [email protected]. If you opt out, we will continue to contact you by phone, mail, or email as needed for your care.

Important note about text message security

Text messaging is not a secure or encrypted method of communication. Messages we send may contain information about your care, and messages can be viewed by anyone with access to your device or your mobile account. By opting in, you accept this risk. You may ask us at any time to communicate with you by an alternative means or at an alternative location, as provided under 45 CFR 164.522(b), and we will accommodate reasonable requests. Do not use text messaging for medical emergencies — call 911.

7. Data Security

We maintain administrative, technical, and physical safeguards designed to protect the information we hold against unauthorized access, disclosure, alteration, and destruction. Access to patient information is limited to workforce members and vendors who need it to do their jobs. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

8. Data Retention

We retain information for as long as necessary to fulfill the purposes described in this policy, to provide and document your care, and to comply with our legal, regulatory, and professional recordkeeping obligations. Medical records are retained for the period required by applicable state and federal law.

Records of your text messaging consent and any opt-out request — including your mobile number, the date and method of consent, and the date of any opt-out — are retained for as long as your number is enrolled in our messaging program and for a reasonable period afterward, in order to honor your opt-out and to demonstrate compliance with applicable messaging rules.

9. Your Choices and Rights

You may:

  • Ask us what information we hold about you, and request a copy;
  • Ask us to correct information that is inaccurate or incomplete;
  • Ask us to delete information, subject to the records we are legally required to keep;
  • Opt out of text messages at any time, as described in Section 6;
  • Ask us to communicate with you by an alternative means or at an alternative location;
  • Set your browser to refuse or delete cookies.

To make a request, contact us using the details in Section 13. We will respond as promptly as we reasonably can, consistent with our obligations as a healthcare provider. Rights relating specifically to your protected health information are described in our Notice of Privacy Practices.

10. Children’s Privacy

Our website is not directed to children under 13, and we do not knowingly collect personal information from children under 13 through the website. Where we treat a minor patient, information is provided and managed by the minor’s parent or legal guardian in accordance with applicable law. If you believe a child has provided us information through the website, please contact us and we will delete it.

11. Links to Other Websites

Our website may link to sites we do not operate, such as a patient portal, scheduling tool, or informational resource. We are not responsible for the privacy practices or content of those sites. We encourage you to read the privacy policy of any site you visit.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the Effective Date at the top of this page and post the updated policy here. Material changes affecting how we use your information will be identified clearly. Your continued use of our website or our messaging program after an update means you accept the revised policy.
